The class action lawusit is a civil case. Regardless of the outcome of that case, neither McBride nor anyone else has any criminal exposure. The SEC investigation is a different matter altogether and may well result in criminal prosecution.

I'm not ready to jump in and defend McBride's decision to vote his shares, as I found it surprising as well, but I think it's a bit of a stretch to fit him with prison garb quite yet.

Fortunately, the judicial system relies a little more on facts than assumption.

How do you know the civil suit is proceeding?

I am not sure of the correlation to voting shares and the judge accepting the merits of the civil suit.

As Seahag said, not voting the shares could be a NEGATIVE vote and would have thrown out the current management team. Now who here really wants the new management team thrown out????

cabos_tacos, you sure seem to be jumping back and forth over that fence a lot here lately.

Cabos, the burden of proof is not as stringent in the Civil Courts as it is in the criminal courts. Even if Sevu and Rich are found liable in the Civil Case I don't think that will have any impact on the probation. Again I'm not an attorney but to be criminally responsible is a far cry from where these cases may be leading, IMO. You also have to consider "intent". I don't know that the evidence in even a civil case will be enough. We'll have to wait and see what they have. I've been seeing a lot of "candidate for arbitration" which may mean that this will never go to court. Wish I had a crystal ball. SH

Now, What exactly is the Videocom deal. The shareholders have no idea what the EXACT deal with Videocom is? This "lease" is the backbone of what little is left of SEVU.
