The 70% you are citing is extremely jaded. You need to include every issued patent that still have life in order to discover the true percentage of patents that could not withstand the presumption of validity.. However, you still missed the point. The patent holder is responsible for every bit of the matters provided to the examiners. If they omitted something or erred in the presentation of certain language, this is not the fault of the USPO.
