Yes, they are the ones who provided the infringing hardware to the cable companies. Cisco is the nexus of this entire thing, and they will have no choice but to pay handsomely to settle all of this. The easiest route is a settlement and buyout of the patents. Both are necessary because a simple purchase of the patents does not award them ownership of the patents retroactively. Atonement must be made for the violations that have already taken place.

One way around this would be to buy UOIP in its entirety. That will cost a lot more than simply buying the patents, but it would avoid a settlement for past damages since UOIP would belong to Cisco and they wouldn't sue themselves.
