"empirical defense" this isn't science. An 8K is as binding a document as can possibly be here. To decry the illegitimacy of an 8K is to basically say "Don't invest in the penny market at all." But everyone who says that is still here, thus showing "empirically" that they aren't following their own advice. Thus their advice is intended for some other purpose.
