If you are the FDA, do you want to agree to anything that will result in permanent injunction? Absolutely not. FDA are perfectly happy with AMRN using 1A however they use it now, as long as it doesn't become precedent-setting permanent injunction. Why can't this go on forever (until RI is approved / not approved)? Because AMRN knows that they hold the keys (can go to the judge anytime and request PI) and are seeking something in return (for them not going to the judge).
