A valid point but what makes you so sure that MaxSound will be willing to settle after the Dec 8th hearing. What you are saying is that if Google thinks it will lose, it will come to the table in the weeks between the hearing and the decision. But if Google thinks it will lose, MaxSound should be more inclined to let it ride since the judge's tone would indicate that the injunction will be granted. If Google has any doubt about its chances, the only time it has any leverage is prior to Dec 8. After then, it may be totally out of their hands even if they want to settle.
