What is not true? Hearing result won't be out til a few weeks after the 8th of December. In that few weeks after the hearing, they will decide to fight on, which is wait for the result and appeal if MAXD ever wins on the permanent injunction or they will settle. If they feel the tone of the judges is leaning toward them, then they won't settle. Google will make their decision after the Dec 8th hearing not before! Netflix will follow what exactly google does.
