GUN: If we lose the infringement issues or the validity issues, then we have lost the case our case in chief. At that point, there is no need to have a trial on the defensive issues of "inequitable conduct". Therefore, all parties, including the court, save time and money by not proceeding further, but for appeals of the underlying issues of infringement.

Should IDCC win infringement on NOK, then "inequitable conducts" will be tried.
