Listen to how it went down. He waived his five minute rebuttal because there was nothing to say. Goog did not bother to address it at all. That was huge in my opinion and should result in summary judgement on the latches appeal.
As far as tone goes, judges, always play that hand. I suppose it becomes an acquired skill over time. Means little in my experience in front of plenty of them. They like to keep the lawyers on their toes.
