Thanks OD, that was a good read and answered many of my questions, but more importantly and hopefully, it will satisfy the questions Judge Essex has. After all, from one of the 2/14/14 hearing transcripts he stated that he had concerns over another possible remandand that was regarding the “Federal Circuit Remand” of the 613 being introduced into the 868!
Additionally IMO, on 2/14, he all but asked the attorneys for help, which was provided by the Markman hearing of Mar.12, 2014. :') 19 So I'll look for help from the attorneys in this Z0 case to tell me what I can and cannot do with it and how Z1 much that claim construction is binding upon me from the 12 Federal Circuit and Commission.
