IMO: If I were in Samsung shoes. What is my advantages in settle with IDCC earlier before ICC decision? IDCC could not (and will not) give them rate better than Nokia rate table. If IDCC reduce rate to give Samsung better than Nokia then IDCC would have to go back to give Nokia same. All I can see is no settlement until ICC decision. So what is the point in settle with IDCC early. Money in the bank with more interest.
I don't see how IDCC could have any incentive to induce Samsung to settle first before Nokia without effect Nokia rate?
Since there are no earlier agreement with LG. IDCC may have induce LG to sign and promise them to have the same (or similar) deal with MFL for early bird licensee.
