Can Qualcomm file a competing plan with the bankruptcy court?

They bought 5.3 million shares of A123 in 4th qtr and are still holding them as of Dec 31, 2012. Qualcomm's CEO was on A123's board until July 2012. Why would they buy that many shares after a bankruptcy filing? Very interesting.
