Mickey: It looks like the ITC Commission doesn't agree with you oft stated opinion that all they have to do is is rule that Nokia infringed and issue a ban. Yesterday they issued a remand order that called for the following:

1 Within 10 days “parties shall submit initial comments regarding what further proceedings must be conducted to comply with the August 1, 2012, judgement of the U. S. Court of Appeals for the Federal Circuit”

2. Within 5 business days after after receiving comments “the parties shall submit their response comments”

3 The parties shall address whether any issues should be remanded to an ALJ.


As I have previously stated, the usual procedure would be to have an ALJ perform a remand investigation (item 3 above).
