I have no love for Brian Rosen, but I don't blame him for all that happened either. He was only a tool, hired and used by those who had powerful positions in bonds and notes, and he did his job, dismembering BK law and using the power of the courtroom to execute a result for those who hired him.

Had Rosen been OUR tool, I suspect we'd be in love with him.

Blame - if any can justifiably be placed - lies with the old BOD and the Hedge Funds who cooked up a plan to ass-out equity/shareholders. And with a judge who did not have any reason or impetus to put a halt to a number of shenanigans, the die was cast. She was within the law and her powers as judge to do as she did, but any number of opportunities to interject a higher threshold of ethics on the part of equity interests were passed over - and the combination of the two: powerful Hedge funds, and a judge who was not inclined to go any further in the exercise of her powers, were the primary factors which brought us to where we are. Not Brian Rosen.
