you've obviously misinterpreted this entire case
i hope you don't have money invested

the patents cover a process which google uses to rank content such as advertising etc based on a Quality score and present relevant advertising to the end user.. this is the business model which has made google so much money over the years...

if google changed their business model then they would not reap in the kinds of revenues that they do now.. no amount of source code rewriting or "patching" is going to change that..

this is a patent case not a copyright case... VRNG does not have to demonstrate that google stole the Lycos source code... VRNG needs only to demonstrate that the process by which google ranks their advertisements and content IS identical to the process described in the patent.

EDIT: an over simplified example
it would be like owning the patent for making a cake... one does not need to demonstrate that the ingredients and quantities are the same.. one needs on demonstrate that the process of making a cake is done in the same way.. ie.. ingredients mixed, poured into a mold, put in the oven and then baked for an hour...
