dmceng - Well, legally I don't think it's classified as "hearsay" -- it's factual, in most part. Now certainly some of the arguments may be dismissed by an opposing party {like, travel is reasonable and customary, etc, etc}

But basically without a motion that requires the court to actually take action on, and without argument - otherwise it's a one-sided rebuttal, you're relying on the court to "do the right thing" and let the argument stand on it's own, and to act "sua sponte" (eg, on their own)

Rarely done as we've seen.
