True, and don't you think we'd need to do some discovery to gather evidence? I do. How quickly do you believe that discovery would occur? JPM, the FDIC, and WGM all thwarted discovery every which way in our case. Do you really think the likes of Goldman Sachs won't do the same?

Another thing to consider is that there are hundreds of millions of dollars above equity that need to be paid out first, so unless liquidating assets get us there--and we only have conjecture and no factual basis for believing that's the case--it'll take awhile before any litigation proceeds reach equity in the NewCo.

Don't get me wrong, I am thankful for the litigating trust, and I do believe it will be beneficial to equity. My hunch is that it will be years before that benefit is realized, however. And that's assuming the company has survived for that long. (For the record, despite some misgivings about this POR, I do believe NewCo will survive.)
