Well most people have known what I think about who is in charge of WMI’s chapter 11 and my opinions early on were based on one’s actions and nothing more. In the early beginning, I was a big fan of Walrath, but that was only because she APPEARED, based on her actions to have the “right stuff”, however my opinions soon changed. I did not change, I changed based on her actions, that do not even closely resemble a “fair and reasonable” Judge, only one who is directly in bed with the criminals, aiding and abetting one of the worst financial crimes this world has EVER seen.
Now let’s talk about what are true heroes (at least they are by their actions so far) are going to do about this continuing crime of financial terrorism. Keep in mind, many people are worried about Susman getting the goods on the criminals or he already has them and then our beloved Walrath will not enforce anything or not even find them in contempt of court when they refuse to give up anything. I would not be surprised if she has not already said for the second time in her court that there will be no sanctions, my God that might force assets to be greater than liabilities.
Here is what I think Susman is doing and why it was SO IMPORTANT for him to get discovery issued against these criminals. Most people think Susman wanted discovery against these people to use IN COURT. Well he may, but first even if he does not get anything turned over to him, he already has some evidence and this is where Susman’s allies come in. I think the allies will be from the FBI, DOJ or some power to put these criminals away, before he uses it in court so Walrath can bury it. This will greatly ENHANCE cooperation not found in her court before she can FIX it more.
These people that Susman has evidence on will either play ball with Susman or he will ensure they go to prison. Usually this is the most effective bargaining chips one can have and when you have the evidence, the power to get more and allies willing to enforce it, NOW that my friends is how you get around a Judge who is aiding and abetting the criminals. Once again, USE THE COURT to get what you need and then enforce it outside of the bankruptcy court and there is NOT much Walrath can do about that because the criminals will concede working WITH equity before Susman puts them in jail.
