There's no certainty in any litigation. That's why we often have settlements on the courthouse steps (to avoid extreme surprises in either direction). IDCC knows they have the strongest case, but that's no guarantee they will win hands down. Nokia knows the claims construction by the ITC was in error, but they may want to see which three judges are on the panel before they decide the prudent thing to do is to settle.

My odds are 60:40, and I'm sticking to that, but like I said it wouldn't surprise me if Nokia goes through with orals. Each side has a lot to lose if the oral arguments proceed.

IMHO, the questions by the panel will reveal a lot about their thinking, and will change the settlement offers significantly after the arguments.
