CXAC is not a defendant, however, I believe SEC can bring civil charges against any party while SEC investigation is still in play. Correct me if wrong, but I believe 37% of the outstanding shares in question were registered by JB prior to sale which leaves me to believe no fault by CXAC. IMO there will not be any penalties associated with CXAC, but who knows for sure if we have heard the whole story.
