I haven't listened to the court hearing yet but according to the posts I have read maybe the WMI lawyer did not carefully choose his words. Isn't it speculation to say "we do not expect any recovery for the commons and maybe just partial for the preferreds"?


Would it not have been more helpful to have just said something like "as our MOR stands now there is no recovery showing for the preferred and common shareholders".


I think the way WMI's lawyer may have stated WMI's position may have been insensitive.
