Weil can not speculate in open court to the Judge. Weil can not lie or attempt to mislead the Judge. Didn't you say you were an attorney and you know the law. Come on, you should know that Weil can not try to influence the Judge or use future rulings as a basis for their argument, they also can not use HEARSAY!

What is a FACT:
1. The US Trustee feels it is necessary that EQUITY be represented. US Trustee believes Equity should have a seat at the table and a hand in the application process for a reorganization plan. WAMU is currently in CHAP 11 REORGANIZATION, NOT CHAP 7. The US Trustee would not even bother with an EC if he thought otherwise.
2. As of today the Common shares of WAMUQ have a value of .13 PPS.
To many that is not TOAST! As you so delicately put it.
3. THJMW has before her a Motion of Summary Judgement that she will be deciding in the future. The Motion if ruled in the Holding Company's favor, will add significant value to the estate.
4. WMI has filed an Adversary Proceeding against JPM for 16 more counter-claims excluding the already argued and briefed SJ. These could add significant value to the estate if ruled in WMI's favor.
5. Flippers and Daytraders have an affect on a stock and will cause a major drop or run, this is the market. Many will take profits or losses, this is the market.
6. The NEW IRS carryback rule, could add significant value to the estate in the form of Tax Refunds. Many here have estimated from as low as 3 Bil to as high as 7 Bil ..
WAMU is not any different than any other stock, it currently moves on volume, news and hearings. And IT IS NOT TOAST!
