I was thinking the same till I read Mordicai's post that suggested that if it was indeed tied to the overall settlement, then they need not have had a hearing and argued in court and submitted so many documents and asked the judge for a ruling. Since they have done all that, I guess its safe to assume that the 4 Billion is not tied to any settlement talks. But a settlement during the holiday season cannot be ruled out as that would considerably tone down the backlash that JPM and the FDIC would feel from such an event.

Edit: I believe that the 4 Billion SJ will be out anyday now.. I am hopeful that it will be before the Omnibus.. we should see a good run leading up to it!!
