gatt, this whole thing stinks if you ask me. We always seem to come to the point where IDCC's success or failure depends on some trivial dispute over terms like "if" versus "when", or "base station" versus "base stations". It seems like the courts often cannot see the forest for the trees.

The problem is that NOK simply had better attorneys, or they know whose palms to grease to get their way.

Anyway, one who is skilled in the art would not even question whether the same code is used for both scrambling and descrambling, and IDCC's expert made this point in his testimony. So I can't fathom why the staff would contend that there is any question whether the patent makes this point clearly enough. It almost goes without saying, it is so obvious to anyone skilled in the art.
