Jerle it is as simple as this.
The FDIC is trying to hide behind FIRREA and Walrath knows this. The latest appeal I just read basically states Walrath did not have the legal authority as a junior court to make the decisions she made. UH-OH Good Job FDIC you just pissed off a BK Judge with 14 years experience in her courtroom and plenty of friends in high places. As the FDIC keeps digging th ehole deeper, hoping a higher (appealate) court will bail them and JPM out, they keep sinking deeper and deeper into a sinkhole in front of our judge. i would expect a contempt charge folloowed by sanctions on both them and JPM for wasting all courts time. This is getting fun. I posted the settlement info back in May. I still stick to what I said.
