You are mixing SEC requirements with NASDAQ requirements. In the case you gave the company violated the SEC requirements first which eventually triggers a NASDAQ violation. There is a period of time between those events.

As outlined in the letter from NASDAQ to Wave, there is an appeal process. However, I believe it is reasonable to assume a move to the Capital Market if the appeal is taken under consideration.

If an appeal is not filed or is not taken under consideration, Wave will have to apply to the Capital Market for listing. That application does not have to be accepted.

I think it is reasonable to assume that Wave has already filed the application to the NASDAQ Capital Market.
