I would think that the court will have to step in at this point and demand both parties come to an agreement as to proceeding to trial. The court wanted both sides to come to do this themselves but this may not be feasible right now. I don't believe the court will allow this to keep on going and going. I would certainly be interested in hearing Mosh's counter to PXD's motion from yesterday.
