The Nok hired gun has taken a phrase stating that the policies of ETSI are governed under French law and states that any member with essential patents who has agreed to be PREPARED to offer a license under FRAND terms has subjected their business contractual dealings to French law regardless where the parties to the contracts reside, where the contract is to be performed or how many essential patents are involved. He states that a separate license must be executed for each essential patent because of the one subject per contract law of France. Of course the formation and policy making would be governed under the laws of France because ETSI sits in France. ETSI never has and apparently never will take on the licensing matters. ETSI considers the licensing to be business as usual between the parties and under the laws in which they reside and conduct business.

I would pay money to be the judge for just this pompous little bostord's testimony. I would find out how much he has been paid for his services and then hold him in contempt, place him in jail, fine him the amount of his fee to be paid before release and make him write a report on what he has learned about contracting with Nok to come to this country and insult the intelligence of the USA and the employees of the ITC.
