My reading between the lines of public Court filings and my own contacts(as opposed to MikeWhite's assuring me yesterday that his source was "VERY RELIABLE", then claiming "reversal") tells me the case is moving forward, which indicates that there will soon be a new Docket Control Order (DCO) filed, re-setting the discovery deadline and trial date. My read is that the Court wants the litigants to set their own reasonably doable timelines in order to insure against appeal. At some point very soon, she will likely have a telephonic hearing to request, arbitrate and set those deadlines, followed quickly by a formal approval of the plaintiff's Motion for Extended Discovery, Compel Discovery and Expert Witnesses, and denial of pxd's MSJ on standing. The fact that she hasn't done that yet indicates that she has allowed the plaintiff's to proceed with discovery pending their timely agreement on the "new DCO)". Since she hasn't ruled on pxd's standing issue defense, but yet has requested a new DCO speaks for itself. Judges don't always put everything in black and white, leaving their actions open to some interpretations; that being said, then this is my interpretation from several hundred miles away.
I would like a seasoned Texas trial attorney's interpretation, so if anyone out there knows one of those, please get that and report back to us. I think you know from my past comments that I do not pump and dump and have been in this for the duration for over 2 decades with 7 figure holdings.
