Call them and say both Scottrade and Ameritrade have come through for their clients, and ask why you should continue to use their service if they can't match the performance of other brokers.

I suspect that tactic (taken by some of us early this week with Ameritrade) may be why Atrade came through with our shares today. eg: On Tuesday, I made it very clear to a Reorg mgr that I was "disappointed" and had plenty of other choices for brokerages, including rival Scottrade, who had already come through (more or less) for their clients.

ymmv, but seems worth a try. Also mention the class action suit you are considering with the other Etrade holders on this board. The more they hear this (from different people), the more likely they are to consider it a real threat.
