no that is not fine,it's nonsense
a dismissed or denied appeal does not reverse a ruling and wipe the slate clean.
just the opposite,it supports the previous ruling.
anybody that has spent any time in court and money paying lawyers is well aware of that.it was a losing battle so G backed down,the smart thing to do....the only thing to do.i would wager that pretty much everybody is aware of that but the constant spin seems to create an air of cognitive dissonance. or to put it simply,denial.
