The National Lithium Policy for Chile

INTRODUCTION


Chile has a historic opportunity. Chile has lithium. Chile can have a better future for families. The objective of this National Lithium Policy (Strategy) is to increase the country's wealth by developing a key industry as a fundamental step in linking Chile's economic development with the shift to a global green economy.

High world demand, high prices and the large reserves of this mineral in our country allow us to be optimistic and, at the same time, they call us to act with a sense of urgency. It is necessary to incorporate capital, technology, sustainability and value addition, in harmony with the communities. To this end, the development of the industry will be led by the State and will involve the private sector throughout the production process.

With Codelco and ENAMI playing an initial role in this strategy as representatives of the State, always seeking majority control. The creation of the National Lithium Company (NLC) will articulate future public-private action efforts. The project will increase domestic production, attract new players and expand the industry through joint initiatives. It will allow, for example, greater sustainable production in the Salar de Atacama and new projects in other salares in the country.

Based on these objectives and strategic definitions, progress will be made on the basis of the following milestones:
II. Milestones of the Policy (Strategy).


1. Initiate a process of dialogue and participation with the various stakeholders. The process will include representatives of communities and indigenous peoples, regional governments, academia, productive enterprises, civil society, as well as central government and other public agencies. This process will make it possible to collect the expectations and proposals of various stakeholders, including indigenous communities, regarding the development of the industry. The results of the process will contribute to the definitions to be adopted in terms of institutional modernization to ensure the sustainable development of the sector, including the creation of a National Lithium Company (NLC) and specific activities of the Lithium and Salares Technological and Public Research Institute.

The design of this process will use as a frame of reference the international agreements ratified by Chile (ILO Convention 169, Escazú Agreement), international standards for mining in the field of relations with interest groups IRMA, ICMMM and the regulations of the Ministry of Mining and the Ministry of the Environment in matters of citizen participation processes and Human Rights plans.

2. To create the National Lithium Company (NLC), that can participate in the entire lithium industrial cycle, from the resource subsidiary and exploitation of the mineral, to its refinement treatment and subsequent industrial stages, such as the assembly of battery cells, and recycling. 3. Create a Network of Protected salares and in those salares under exploitation, ensure the use of low environmental impact technologies. The salt marshes are complex, unique and highly bio-diverse

suffering significant degradation at a global level, as in Chile. This makes it necessary to safeguard the long-term ecological sustainability of these ecosystems. For this reason, the strategy contemplates the creation of a network of protected salt flat systems, composed of at least 30% of the surface of these ecosystems, in line with the international obligations committed by Chile in the Framework Convention on Biodiversity.

In those salares that are exploited, the implementation of technologies that minimize the environmental impact in the recovery of lithium will be required, such as Direct Lithium Extraction (DLE) with reinjection of brine and the reduction of fresh water consumption. Also, monitoring of the bio/geo-chemical effects of these techniques. In addition, the process of incorporating Chile to the EITI initiative will be initiated (Extractive Industries Transparency Initiative), to ensure the greatest transparency and probity in all extractive industries, including lithium mining, meeting the highest international standards.

4. Modernize the institutional framework. The institutional framework associated with lithium and the salares is complex, involves a series of participants, and there is currently no global and coordinated view of its different dimensions. A review is required that includes the regulations governing the supervisory bodies and the relationship between central decisions and regional and communal governments.

A proposal will be made for institutional modernization that will allow the development and growth of the industry, safeguarding the impacts on the salares, and giving coherence to existing and new bodies, all in accordance with the objectives of this strategy. The proposal will consider the work of the 2014 National Lithium Commission, the work developed during 2022 by the Inter-Ministerial Roundtable led by the Ministry of Mining, and the results of the dialogue process mentioned above.

5. Create a Public Technological and Research Institute for Lithium and Salt Flats. An Institute will be created whose main objective will be the generation of knowledge and technologies that will improve the processes of extraction, production, value addition, applications and recycling, in addition to improving the understanding of the salt flats, through the

generation of robust models that allow minimizing the impact associated with lithium extraction and processing operations, and salares, through the construction of public ecosystem baselines. It will combine these efforts with research capacities in ecology, geology and social sciences on salt flats and their communities, contributing to good conservation, supervision, and regulation of the sector, and to efficient and informed decision-making from the State. The Institute will also collaborate with the cadastre of resources and other environmental components that will be carried out by private companies and state companies. It will be in charge of compiling and making available information in terms of natural capital, and on exploration and exploitation projects, both in their formulation and design stages and in their execution, in accordance with the provisions for access to environmental information contemplated by the Escazú agreement.

6. Incorporate the State in the productive activity of the Salar de Atacama. Given that in 2030 the lease of an important part of the Salar de Atacama to private companies will end, this will make it possible to regain control of lithium for Chile. The participation of the State in the exploitation of lithium will allow that the valuable public-private articulation will always be to the benefit of the people of Chile and its development.

In this framework, CORFO will ask Codelco to search for the best ways to achieve from now on the participation of the Chilean State in the extraction of lithium in the Atacama salares. In this way, Codelco will be the State's representative before the companies that are currently in the salar, in order to have the State's participation before the expiration of the current contracts. Codelco will also lead the conversations that are convenient with other companies for the further development of the salar. In this regard, two considerations: First, in the event that a public-private company is formed to exploit the lithium in the Atacama salares, it will be controlled by the State, through Codelco. Secondly, the State of Chile will fully respect the provisions of the current contracts. That is, an anticipated participation of the State in the Salar de Atacama will be the result of an agreement with those who currently have the rights to exploit the lithium.

7. Prospecting for other salares. The resources available in other salares need to be mapped and the conditions for their potential lithium extraction need to be created in a responsible and sustainable manner, as long as they do not belong to the network of protected salares. For exploitation projects with strategic value for the country, public-private partnerships will be established with control of production decisions by the State. For all projects, the conditions and benefits for the State and the communities that are currently established in the contracts that CORFO maintains in the Salar de Atacama (resources for communities, regional governments, local governments, research and development) will be considered as a floor, in addition to environmental and technological requirements, quotas for value-added projects, among others.

In this framework:
a. Special Lithium Operation Contracts (CEOL) for exploration and exploitation will be granted to subsidiaries of state-owned companies Codelco and ENAMI in those salares where they already have projects in different stages of development. These companies will be able to decide whether or not to partner with a private company.
b. For the other salares that are considered susceptible to exploitation (given the preservation restrictions), a public, transparent and informed bidding process will be initiated for private bidding for CEOL exploration. In the event that the results of the exploration show potential, the private company will have a preferential option to partner with a State company for the exploitation stage. In the case of projects of strategic value for the country, this association must have a majority participation of the State. This process will allow accelerating the exploration of the salares, and will provide a space for the different national and international participants interested to enter the industry. Resources will be generated for the State from the bids, and the costs associated with exploration will be incurred by the private sector, which must report them to the Institute on an ongoing basis. The bids submitted in the CEOL bids for exploration must also include a proposal for a plan to generate local value and productive linkages that the eventual exploration project would have exploitation, in order to favor initiatives that involve greater local production chains, technological development and value addition.

8. Create the CORFO Committee for Productive Transformation around lithium led by the Ministry of Mining. This Committee will be in charge of promoting productive transformation and proposing scientific-technological and industrial development policies that will allow the development of new productive activities upstream and downstream in the lithium cycle, as well as identifying and taking advantage of opportunities for linkages and value addition at the local level in the industry.
