Unfortunately, there was also a chance," high, low" percentage of Eltp being caught up in the litigation. If that were to happen, there would be Attorney costs to defend, or potentially payouts. This could have ended very badly, as I said, sometimes the safe approach allows one to live for another day.

Nonsense. This whole "we coulda been caught up in litigation" attitude just lets the responsible players off the hook by making it seem like something everybody was doing and anybody could get in trouble for. Bullshit. This was a problem caused by a discrete number of identifiable corporations that are now being held to account for their specific actions. The executives of some of these companies are damn lucky to avoid criminal liability, and I suspect it may influence their subsequent business decisions.

What exactly did Elite do that would put them at risk for litigation?

Then the lights were dimmed, and Boockholdt ticked through 60 charts and graphs showing that Actavis had sent nearly 240 million pills to Florida during the previous 30 months — more oxycodone than the manufacturer had sent to almost all other states combined.

Actavis officials were taken aback, the court records show. Michael R. Clarke, the company’s vice president for ethics and compliance, testified in a deposition that it felt like DEA officials were treating Actavis like “street dealers.”
