O re your analysis

when Newman was asking Marjac about his expectation for court action, she was looking to see if there was a commonsense solution that she could sway one or both of the other judges to resolve the suit fairly.
Thankfully Marjac brought up remanding the case to Du.
I believe it would be a bridge to far for the other judges to vacate and decide.
I believe we are looking at a 2 to 1 decision.



My take also ......strong case to remand based on statistical error / new findings ...tough to overcome a rejection based on standing
