Kiwi, my interpretation was at the end, when Newman was asking Marjac about his expectation for court action, she was looking to see if there was a commonsense solution that she could sway one or both of the other judges to resolve the suit fairly. Thankfully Marjac brought up remanding the case to Du. I believe it would be a bridge to far for the other judges to vacate and decide. I believe we are looking at a 2 to 1 decision. The question is, can she bring a judge over to her side on standing. A positive is I do believe the judges see error in Du's ruling based on statistical error. I have trouble seeing how they ignore that, but still give us a 40% chance of remand.

Also, I could be wrong, but after listening to orals, we only got to a hearing because Newman wanted one.

ps...Jas, I forgot to mention in my response to you that they will remand based on our appeal of standing.
