Based on this news release and the statement below:

Charges laid under the Securities Act (quasi-criminal) are prosecuted by the OSC. Charges laid under the Criminal Code are prosecuted by the Ministry of the Attorney General.

Cant be 100 percent certain, but It appears that This OSC enforcement task force doesnt have the power to lay criminal charges. The OSC can only charge quasi criminally.

Too funny though as many were saying a quasi criminal charge as similar to a traffic ticket. I bet this couple dont feel like its a traffic ticket. As well, they are accused of only taking 750k. Grants total was 9.4 million if I remember correctly.
