WebSlinger is correct. This is a deceptive PR.

KBLB has not been awarded a patent by the EU. If this had happened, there would be a patent number. No patent number, no patent.

Thompson is announcing that KBLB has filed a patent application with the EU. Anyone can file a patent application with any country or (in the case of the EU) a group of countries.

Thompson’s claim that KBLB has patent protection is misleading. If the patent is awarded, then KBLB will have protection retroactive to the point of patent submission. In that sense, he has ‘patent protection.’

In the US, only about 50% of patent applications are ultimately approved, but 86% are rejected on their first submission. Less than 10% turn out to be valuable. For example, Notre Dame has been working for years to patent their work on silkworms and spider silk. Several applications were abandoned and revised submissions have been filed. We don’t know their ultimate fate.

When the patent application is filed, only the abstract is published. This makes it difficult to understand the value of intellectual protection. Once a patent has been awarded, as the Notre Dame patent in Canada, the specific claims can be examined to determine the nature of protection.

This PR deserves at least one Pinocchio.
