3. Patent not granted, but attempt to keep trade secret process secret -- Coke did it, but protection only floes from keeping it a secret. Did you know that if anyone figured out the formula and process to make Coke, you could sell it and compete with them? You couldn't call it Coke (trademark) but anyone can research until they figure it out. Likewise, if there is a secret here - it better stay one.
