So, researching the patent process more, it is apparent that the first attempt for a typical patent application fails; however, particularly with seasoned applicants, the patent office will typically “reach out “ to the applicant during the process to dialogue through concerns and stumbling blocks in order that the second and final attempt (besides appeal) has the best chance at success. It appears to be the reason some second attempts go forward while others are abandoned. Just by the fact that NWBO submitted a second attempt regarding this application, likely means they think they can address the patent office’s prior concerns. JMHO

(Note: NWBO has been granted several patents in the past, but this current application dealing with DCVax-Direct “+” could significantly lengthen and strengthen NWBO’s perceived value. JMHO.)
