Sts, It is my opinion, as a non lawyer, that Hikma would be the target to sue. This is my reasoning. Gsk v Teva holds that knowledge of the infringing use is enough to prove inducement. If Hikma markets GV in a state that requires substitution I don't see any way Hikma can claim they didn't know what was going to happen. So as I see it the state law provides proof of intent. If the board lawyers would care to chime in it would be appreciated.
