I don't think DBMM got lucky at all. These judges actually look at the merits of each individual case. That is their job. No longer is it a rubber stamp job where the fix is in and a "corrupt" court just
goes along with all enforcement decisions. The only reason a precedent is being set is because the judge/s are not corrupt and holding enforcements feet to the fire. This is a good thing and will force enforcement to get with the program and not use a dogmatic aproach once circumstances of the case changes. In other words going forward making butthurt responses to common sense judgements will no longer be appropiate. There is a message here for enforcement, do your job or lose all credibility.

As for overturning the judges decision and ending up in court again is not going to happen. ID is in, no appeal against ID was presented, that ship has sailed. If they allow a review to proceed
and ask both sides for a brief that would be a direct slap in the face to the judge's ID. Not going to happen. The optics of such would bring way too much heat and attention to the comission and put them under intense scrutiny. They are not going to sow the seeds of their own destruction. It will be a beauracratic political decision in favour of the defense and enforcement will just have to suck it up.
