Grey, there was extensive discussion on this topic over the last several months on the Board. My understanding is that it is an unenforceable infringement for lack of a better term. What does that mean?

Basically although the generic V can only be prescribed for the Marine indication, as a practical matter doctors will prescribe it for even the Reduce-It indication. There is no way to sue every doctor under the sun, or every pharmacist who substitutes the cheaper generic irrespective of the indication. Hence the collapse of the stock after the Du decision, and again after being affirmed, as the US market is lost.

That is my understanding. There has been a lot of discussion. If there was a valid, meritorious, practical way to litigate with the big players--generics and insurance companies--to prevent this from happening, then I would be most interested in litigating such a potentially multi-billion dollar case. But the conclusion from the discussion was that such a path was not available.
