Well, others may spin it any way they want but that was a disaster.

What in the world was Singer doing?? How did he not have a good answer on how our case was different than Novo?? That was his one chance. What was his weak answer when asked to describe the most blatant area where Prima Facie was determined prematurely by Judge Du? How extremely disappointing!

I am so bummed right now.

No way IMO we win this case.

The judges did what I thought was very very weak. Basically judge du didn't weight the SC against each other but basically said that Commercial Success and Unmet need didn't overcome Prima Facia. Kurabayashi didn't even come up and how we should have got further credit for SC since patent office did consider.

Time to lick my wounds and decide whether I want to jump ship and save about 100K or stay in this with the thoughts that EU and ROW will carry us past 10 bucks.
