Something really bothers me about these chances of success depending so much on the panel we get - people have pointed out huge errors of law, science, and procedure Du made - how could the CAFC not see the same things? I cannot believe a judge's bias would make them ignore the rules of law, just beyond comprehension to me - maybe that's the structured engineering background I have influencing how I think, as I imagine the appeal should follow a sort of decision tree, not be a free association wander through the woods.
