the problem we have is that AMRN did not present an expert who testified as to the proper statistical interpretation of the Mori and Kur studies.

But did Amarin need to explain the statistical interpretation, rather than just say what it was?

As I mentioned before, Amarin (Toth) said at trial that 2+2*2=6, without explaining WHY it equals to 6. Any reasonable judge should understand this without the WHY.

Du concluded that 2+2×2=8.

Shouldn't Amarin be allowed to explain (during the appeal process) why Du erred and they could not have explained this during the trial, because Du did not err until the ruling (giving Amarin no chance to contest that error)?
