I thought one secondary factor was enough for us to win, but several people have said she weighed the secondaries against each other. I first saw this on the Markman write up, but I think marjac and eight both mentioned this.

It sounds like you're saying we need to flip this one so the new score is 3-2 in our favor, even if weighed against each other?

My hope was that one angle of appeal would be how Judge Du approached the secondary actors as a whole, not weighing them independently.

Sorry if I'm way off here. Just trying to understand. and I'm a few knives short of a full drawer compared to some of the sharp minds on this board.
