I believe the problem is that the appeals court won't be made aware of the Table 3 error or mistaken conclusion made by Du that directly contradicts the conclusions of the Kura authors because AMRN didn't raise the issue during the trial, so they cannot mention it in their appeal briefs. The only way this gets considered in appeals is if the 3 judges independently discover the error - what are the chances of that? They literally will not know that Du incorrectly interpreted the data and may just defer to her decision.
