You cannot raise new arguments on appeal

Yeah maybe. But nothing is stopping the Circuit Court judges from making the effort to understand what is in front of them.

Appeal after appeal (that I browsed, thanks to Mikenac) shows the Circuit judges wading in, doing the hard work of understanding technical details, and then STUFFING the FACES of the district court judges in their sloppy work.

Just because Covington didn't explain what "statistical significance between arms" was, doesn't mean a POSA wouldn't have understood it, and it doesn't mean the Circuit judges won't make that effort.
