OK, you stated that you only had one question, which apparently nobody has answered to your satisfaction yet. That question pertained to which court decision has more weight. Well here you go:

The fact that the decision CAN be appealed puts the appellate decision in superiority. Now it may only have been shot down on a technicality, but sorry about your luck. The next step would be appeal higher or start over. But, since we are talking about a bloated pig of a stock, that can only pay its lawyer by selling more shares, I would suggest dropping it....
