Back to which court? Not gonna happen anyway - FDA has broad authority to do whatever the hell they want and there's nothing illegal about it. To think FDA is trembling at the thought of what AMRN could do, and what risks FDA may be taking, is (sadly) laughable. FDA has an easy out for calling for the AC, which *must* delay PDUFA because it won't be until Nov - the label - in particular whether to allow primary prevention on it. AMRN has no data to support that V is effective for PP.
